Intersexuality and the Law: Current European Approaches

ABSTRACT
Intersexuality is a condition quite problematic for most of the European states, which are traditionally characterised by a binary conception of sex. The legal gap between this condition and national legal systems is usually filled through unnecessary irreversible medical surgeries and hormonal treatment, without informed, full and free consent.
In this work I firstly define intersexuality and the main legal issues related to this condition.
Then, I analyse international and European legal protections for intersex people.
In the third chapter, I consider some of the most interesting measures adopted by certain European states to give an answer to this issue.
Finally, I expose some personal considerations and a possible way forward.
This work shows that intersexuality is still widely invisible for most European legal systems and, as surgeries and hormonal treatment are the most popular solutions, intersex fundamental rights are often at stake.
Legal protections against those kinds of violations are often inappropriate or even absent.
